Anthropic Sues Department of Defense Over AI Supply Chain Risk Designation

Anthropic has followed through on its commitment to legally contest the Department of Defense, following the agency's recent designation of the company as a supply chain risk. The creator of Claude initiated this legal challenge by filing a formal complaint against the Department on Monday.
This legal action culminates a dispute that unfolded over several weeks, centered on whether the military should have open access to Anthropic's artificial intelligence systems. The company maintained two non-negotiable positions: it refused to allow its technology to be utilized for the mass surveillance of American citizens, and it asserted that its AI was not sufficiently developed to operate fully autonomous weapon systems without human oversight for targeting and engagement decisions.
In contrast, Defense Secretary Pete Hegseth contended that the Pentagon should be permitted to employ AI systems for "any lawful purpose." The supply chain risk classification is typically applied to foreign adversaries, and it mandates that any entity conducting business with the Pentagon must verify it does not incorporate Anthropic's models.
In its complaint submitted to a federal court in San Francisco, Anthropic described the DOD's measures as "unprecedented and unlawful." The company's filing states, "The Constitution does not allow the government to wield its enormous power to punish a company for its protected speech."
